Who we are
The Quirky i ("we", "us", "our") is a full-stack marketing, branding and design agency based in Mumbai, India, operating under Quirkora Design Solutions LLP (est. May 2023). We work across branding and identity, packaging design, social media management and content, motion graphics, photography and videography (including shoots involving people and models), pitch and investor decks, performance marketing (including paid campaigns on Meta and Google), e-commerce creative for marketplaces such as Amazon, Flipkart and Shopify, event collaterals, and music-industry content, for clients across industries including health, hygiene, skincare, cosmetics, lifestyle, home, pharma, travel, jewellery, finance, agrotech and AI.
This Privacy Policy explains what personal data we collect, why we collect it, how we use it, who we share it with, and the choices and rights you have - whether you're browsing our website, following or messaging us on social media, submitting an enquiry through one of our ads, taking part in a shoot we're running, or engaging us as a client.
This policy applies to www.thequirkyi.com, to our Instagram, Facebook and LinkedIn pages, to any enquiry you send us through our website, WhatsApp, email, or a Meta lead ad form, and to any personal data we collect in the course of delivering client projects, including content shoots.
Information we collect
We collect personal data in the following ways:

Information you give us directly - for example your name, phone number, email address, business name, job title, and details about the service you're enquiring about, when you contact us via our website, WhatsApp, email, or social media.

Information collected through advertising - when you submit an Instagram or Facebook lead ad form, Meta shares the details you entered with us so we can follow up. Where we run Meta Pixel or Google Ads conversion tracking on our website (see Section 7), we also receive data about which ads led to your visit and whether you took an action we're tracking, such as submitting an enquiry.

Information collected automatically - website usage data (such as your IP address, browser and device type, pages visited, and approximate location) collected through our website platform and, where active, analytics tools such as Google Analytics.

Information collected as part of a project - once you engage us, we may collect business, brand, financial or access information you share with us to deliver the work, and where a project involves photographing or filming people (including models, staff, or members of the public), we collect images, video, audio and likeness under a separate written consent or model release specific to that shoot.

Information collected for billing - invoicing, tax/GST and payment reference details needed to bill for and receive payment for our services.

We do not sell your personal data to anyone, and we do not use it for purposes unrelated to the above without asking you first.
Our legal basis for processing (India - DPDP Act, 2023)
Under India's Digital Personal Data Protection Act, 2023 and the DPDP Rules, 2025, we process your personal data on the basis of your consent - given when you voluntarily submit your details through our website, a lead form, WhatsApp, email, or by signing a model release or project agreement - and, where applicable, for the legitimate purpose of responding to a request you have made or performing a contract with you as our client.
Where we rely on consent (for example, for cookies, analytics, ad tracking, or a shoot involving your image), that consent is free, specific, informed and can be withdrawn as easily as it was given. You can withdraw your consent at any time by contacting us using the details in Section 12. Withdrawing consent does not affect anything we did with your data before that point, and may mean we're unable to continue assisting with your enquiry or project.
How we share your information
We do not sell or rent your personal data. We share it only in these situations:

With advertising and analytics platforms - Meta Platforms, Inc. (Instagram/Facebook lead ads, Meta Pixel and conversions data) and Google (Google Ads and Google Analytics, where active) receive data as described in Sections 2 and 7. Each platform's use of this data is governed by its own privacy policy in addition to this one.

With service providers who support our business - for example, our website host, email and scheduling tools, cloud storage, project management tools, and payment/invoicing providers we use to manage enquiries and client work. These providers only access what they need to provide their service to us.

With freelancers, vendors and collaborators - such as photographers, videographers, editors, or printers we engage on a project, who may need limited access to project or shoot data to complete their part of the work, under confidentiality obligations.

With e-commerce and marketplace platforms - where a project requires publishing content directly to a client's Amazon, Flipkart, Shopify or similar storefront, limited project data may be shared with or accessed via that platform as needed for the deliverable.

Where required by law - if we're legally required to disclose information (for example, in response to a valid court order or government request).

With your consent - in any other situation, only after telling you and getting your agreement.
Some of the tools above (including Meta and Google) may store or process data on servers outside India. Where this happens, we rely on the service providers' own compliance safeguards; we do not transfer your data internationally for any other purpose.
Advertising, tracking pixels and conversions data
We may run paid advertising campaigns on Meta (Instagram/Facebook) and Google, and may use tools such as the Meta Pixel, Meta Conversions API, and Google Ads conversion tracking on our website to understand which campaigns and content lead to genuine enquiries. These tools can involve sharing limited data - such as the fact that a form was submitted, or a page was visited after clicking an ad - with Meta or Google, who may combine it with information they already hold about you under their own privacy policies. This section applies whether or not these specific tools are active on our website at any given time, so that this policy remains accurate as our tracking setup evolves.
You can control how Meta and Google use data about you through their own settings (for example, Meta's Ad Preferences and Google's Ads Settings), and through the cookie/tracking choices described in Section 7.
Cookies and similar technologies
Our website may use cookies and similar technologies, which fall into two categories:

Strictly necessary/functional cookies - set automatically by our website platform to keep the site working correctly and securely (for example, remembering basic session information). These do not require your consent and cannot be switched off.

Analytics and advertising cookies - such as those set by Google Analytics, Google Ads, or the Meta Pixel, used to understand site usage and measure advertising performance. Where these are active, we will provide a cookie consent mechanism allowing you to accept or decline non-essential cookies before they are set, in line with applicable law.
If, at the time you're reading this, our website is not yet running Google Analytics or a Meta Pixel, this section still describes how we will handle them once they are switched on, so this policy does not need to be revised at that point. If you'd like to know exactly which tools are active right now, contact us using the details in Section 12.
Data security
We take reasonable technical and organisational measures to protect your personal data against unauthorised access, loss, misuse, or alteration - including relying on the security infrastructure provided by our website host, Meta, Google and other service providers for the respective parts of our data flow they handle, and limiting access to project, shoot and financial data to team members and vendors who need it to do their work. However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security.
Data retention
We keep personal data only for as long as necessary for the purposes described in this policy. As a general guide: enquiry and lead data is kept for 24 months from your last contact with us if you do not become a client; client project data is kept for the duration of our engagement plus a reasonable period afterward (typically up to 7 years) for record-keeping; shoot/model data is kept as specified in the relevant release or agreement; and billing data is kept as required under applicable Indian tax and company-law rules (generally up to 8 years). After the applicable period, we delete or anonymise your data unless we're required to keep it for legal reasons.
Your rights
Under India's DPDP Act, 2023, you have the right to:

Children's privacy
Our services are intended for businesses and individuals who are able to enter into a commercial engagement with us, and any shoot involving a minor is only carried out with the verifiable consent of a parent or legal guardian, obtained separately through a written release. We do not otherwise knowingly collect personal data from children. If you believe a child has provided us with personal data without appropriate consent, please contact us and we will delete it.

We aim to acknowledge grievances promptly and resolve them within a reasonable timeframe. If you're not satisfied with our response, you may escalate your complaint to India's Data Protection Board.
Changes to this policy
We may update this Privacy Policy from time to time - for example, if we add new tools or services, or change how we handle enquiries or data. This version has been written to already cover tools such as Google Analytics and Meta Pixel/conversion tracking, so switching those on does not, by itself, require an update. We'll update the "Last updated" date at the top of this page whenever we do make a change, and encourage you to review this policy periodically.
